Welcome to Estaro. By accessing or using our service, you agree to be bound by these Terms of Use. Please read them carefully.
1. Acceptance of Terms
By creating an account, accessing, or using Estaro's services, you agree to these Terms of Use and our Privacy Policy. If you do not agree, you may not use our services. These terms constitute a legally binding agreement between you and Estaro.
2. Service Description
Estaro provides an AI-powered conversational platform for real estate professionals to respond to leads, capture contact information, and track conversations through website chat widgets, Telegram integration, and a management dashboard. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with or without notice.
3. Eligibility and Account Registration
You must be at least 18 years old and legally capable of entering into binding contracts to use Estaro. By creating an account, you represent and warrant that all registration information you submit is accurate and current. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Subscription Plans and Payments
Estaro offers subscription plans including a 14-day free trial, Individual Agent plan ($49/month or $490/year), and Team/Brokerage plan ($199/month or $1,990/year). All fees are exclusive of taxes. Subscriptions automatically renew unless cancelled before the renewal date. We reserve the right to change our pricing with 30 days' notice. Refunds are provided at our sole discretion.
5. Acceptable Use Policy
You agree to use the service only for lawful purposes and in accordance with these Terms. You may not: (a) use the service to violate any laws or regulations; (b) upload malicious code or attempt to gain unauthorized access; (c) interfere with or disrupt the service; (d) use the service to send spam or unsolicited communications; (e) impersonate others or provide false information; (f) reverse engineer or attempt to extract source code; or (g) use the service in any way that could damage our reputation or business.
6. User Content and Data
You retain all rights to the content and data you upload to Estaro (your "User Content"). By uploading User Content, you grant us a limited license to store, process, and display your content solely to provide the services. You are solely responsible for your User Content and must ensure you have all necessary rights to upload it. We may remove User Content that violates these Terms or applicable law.
7. Intellectual Property Rights
All content, features, functionality, and materials available through Estaro, including but not limited to text, graphics, logos, software, and AI models, are owned by Estaro or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services or software without our express written permission.
8. AI-Generated Responses
Estaro uses artificial intelligence to generate responses to prospect inquiries. While we strive for accuracy, AI-generated responses may contain errors or inaccuracies. You are responsible for reviewing AI-generated content and ensuring it meets your business standards. We do not guarantee the accuracy, completeness, or suitability of AI responses for any particular purpose.
9. Privacy and Data Protection
Our Privacy Policy explains how we collect, use, and protect your personal information. By using Estaro, you consent to our data practices as described in our Privacy Policy. You are responsible for ensuring your use of Estaro complies with applicable data protection laws, including obtaining necessary consents from individuals whose data you process through our service.
10. Service Availability and Support
While we strive to provide reliable service, we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that temporarily affect service availability. Email support is provided for all plans, with priority support available for Team/Brokerage subscribers.
11. Termination
You may cancel your subscription at any time through your account settings. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. Upon termination, your right to access the service ceases immediately. We will retain your data for 30 days after termination, after which it may be permanently deleted.
12. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Estaro, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.
14. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction where Estaro is registered, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court. You waive any right to participate in class action lawsuits.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the service. Your continued use of the service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the service.
16. General Provisions
These Terms constitute the entire agreement between you and Estaro regarding the service. If any provision is found unenforceable, the remaining provisions will continue in full effect. Our failure to enforce any right or provision does not constitute a waiver. You may not assign or transfer these Terms without our written consent. We may assign these Terms at any time.
